Mexico – Extension of paternity leave

What’s new?

A bill which foresees an extension to the current paternity leave entitlements in Mexico has recently been approved by the House of Representatives (the “Bill”). If the Bill is approved by the Senate, the changes will come into force the day after the Bill is published in the Official Gazette. Whilst the exact timing is not confirmed, the Senate is expected to commence its deliberations in February 2024.

What are the key proposed changes to paternity leave?

  1. Paternity leave will increase from 5 to 20 working days with full salary. This will apply whenever an employee has a child which has been born or adopted.
  2. It will be possible to extend paternity leave for up to an additional 30 days where an employee has experienced complications during childbirth, which has affected the mother’s or child’s health.

So, what should employers do now?

Employers should familiarise themselves with the proposed changes to paternity leave and, if the Bill is approved by the Senate, ensure they are compliant once these come into effect. If you need any support with this, or would like any further information, please get in touch with a member of the MDR ONE team.
